What are Defacement Removal Notices
Under certain circumstances, the Local Authority may serve a defacement removal notice on bodies that are responsible for a surface defaced by Graffiti and fly posting, requiring the removal of the Graffiti / fly-posting. If the body does not comply with the notice within the time specified, the local authoritymay carry out the work and reclaim the costs which may result in Legal Action.
How can They?
Sections 48, 49, 50, 51 and 52 of the Anti-social Behaviour
Act 2003 (‘the Act’) (as amended by section 31 of, and paragraphs 16–19 of Schedule 4 to, the Clean Neighbourhoods and Environment Act 2005) enable a local authority to serve a ‘defacement removal notice’ on the owners and businesses whose property is defaced with graffiti and / or fly-posting.
